Terms of Service

These Terms of Service govern your use of AVOW Digital's websites, dashboard, and related services. Additional project terms, deliverables, pricing, and timelines may be stated in an order form or proposal. If those documents conflict with these terms, the signed order form or proposal controls for that project.
1. What we provide
AVOW designs and builds websites, provides hosting and maintenance services, and provides access to a marketing dashboard and related tools under the plan or project you select. Features may include lead management, website forms, listings, content publishing, email, automations, analytics, and third-party integrations.
2. Accounts and authorized users
You are responsible for keeping account credentials secure, maintaining accurate account information, and ensuring that people you authorize use AVOW consistently with these terms. Tell us promptly if you believe an account has been compromised.
3. Fees and billing
- Recurring plans are billed in advance and renew until cancelled according to the applicable order.
- Any setup, design, build, or other one-time fees are described in the applicable order form or proposal.
- Taxes, cancellation terms, trial terms, and refund eligibility are governed by the applicable order and law.
4. Your content and responsibilities
You retain ownership of the content and brand materials you provide. You confirm that you have the rights needed for us to host, process, display, and distribute those materials as required to provide the services. You are responsible for the accuracy and legality of your content, listings, advertising claims, communications, and compliance with applicable real-estate, fair-housing, privacy, anti-spam, brokerage, and MLS rules.
5. Third-party services
AVOW may connect with services such as Google, MLS or IDX providers, payment processors, hosting providers, and email providers. Your use of those services is also governed by their terms and policies. You authorize AVOW to exchange information with a service only when necessary to provide the connection you request. We are not responsible for a third party's independent service availability or changes.
6. AVOW technology
AVOW retains ownership of its dashboard, software, systems, reusable components, internal tools, processes, and other pre-existing technology. Project-specific ownership and licenses for website design and deliverables are stated in the applicable order form or proposal.
7. Acceptable use
You may not use the services to send unlawful, deceptive, abusive, or unsolicited communications; infringe another person's rights; upload malicious code; attempt unauthorized access; interfere with service operation; scrape or reverse-engineer protected systems; or use integrations outside their documented and authorized purposes. We may suspend access when reasonably necessary to protect users, third parties, or the services.
8. Availability and changes
We work to provide reliable services, but availability may be affected by maintenance, security events, internet conditions, and third-party providers. We may improve, replace, or discontinue features, and will provide reasonable notice when a material change negatively affects an active paid service.
9. Disclaimers and limitation of liability
Except for promises expressly stated in a signed agreement, the services are provided “as is” and “as available” to the extent permitted by law. AVOW is not responsible for indirect, incidental, special, consequential, or punitive damages. To the extent permitted by law, AVOW's total liability arising from the services will not exceed the fees paid for the affected service during the twelve months before the event giving rise to the claim.
10. Termination
You may cancel according to your applicable order. Either party may terminate for a material breach that is not cured after reasonable notice. On termination, access to the dashboard and hosted services may end. Data-return, export, retention, and deletion requests are handled according to the applicable agreement and our Privacy Policy.
11. Changes to these terms
We may update these terms to reflect changes to our services or legal obligations. We will post the revised terms here with a new “Last updated” date and provide additional notice when appropriate. Continued use after the effective date constitutes acceptance where permitted by law.
